Synopsis of Bill



House Bill 44 amends Section 31-9-3 NMSA 1978 to allow criminal defendants currently suffering from mental illness to issue pleas of guilty but mentally ill. At this time, the plea of guilty but mentally ill, only applies to defendants who were suffering from mental illness at the time of commission of a criminal offense.
