Synopsis of Bill



SB 231 appropriates $10,000 from the general fund to the New Mexico Mounted Patrol for expenditure in FY 99 and FY 2000 for the purpose of providing training to members of the New Mexico Mounted Patrol. Any unexpended or unencumbered balance remaining at the end of FY 2000 shall revert to the general fund. Additionally, the proposed legislation declares an emergency.



FISCAL IMPLICATIONS



The Department of Public Safety reports there is no apparent impact on the agency from passage of the proposed legislation.



OTHER SUBSTANTIVE ISSUES



SB 231 leads to a grey area in statute which states "The director of the New Mexico state police [division of the department] may, at the expense of members of the New Mexico mounted patrol, execute and deliver to each member of the mounted patrol proper pocket commissions as emergency and voluntary state police, the same to be effective only upon specific request of the New Mexico state police in each instance of service. Such commissions shall bear the written approval of the governor of New Mexico; such commissions shall automatically expire and new ones issued and delivered upon each change in the directorship of the New Mexico state police or the governorship." The referral to " at the expenses of the members of the New Mexico mounted patrol" may prevent the appropriation to be provided to the New Mexico mounted patrol.
