Synopsis of Bill



Senate Finance Committee Substitute for Senate Bill 798 appropriates $650,000 from the general fund to the New Mexico Office of Indian Affairs for the planning, design and construction of two buildings for separate purposes in Mescalero in Otero County.



Significant Issues



Senate Finance Committee Substitute for Senate Bill 798 proposes funds for the construction of two buildings. The first appropriation for $50,000 is for the planning, design and construction of an inter-generational facility for the youth and the elderly of the Mescalero Apache Tribe; and the second is $600,000 for planning and design of phase l of new school buildings for the Mescalero Apache school.



FISCAL IMPLICATIONS



The fiscal and administrative impact to the New Mexico Office of Indian Affairs would be minimal. The agency would have to issue and Request for Proposal (RFP) to contract the proposed project.



TECHNICAL ISSUES



The funding and oversight for phase l of a new school building may be more appropriately placed with the State Department of Education.



It is doubtful the $50,000 appropriation is sufficient for "planning, design and construction." Recommended amendment: On page 1, line 24, change the word "and" to "or".



OTHER SUBSTANTIVE ISSUES



Numerous appropriations for Native American capital outlay projects have not been expended in the last ten years due to a lack of planning and coordination with tribal officials. It is recommended that the entity to be responsible for the operation and maintenance of new buildings be contacted and involved in the planning of the project.
